Terms of Service

These Terms of Service (“Terms”) govern your use of the Katherine AI platform operated by Leadogo LLC (“we,” “our,” or “us”). By accessing or using Katherine AI at app.getkatherine.ai, you agree to be bound by these Terms.

1. Service Description

Katherine AI is an AI-powered voice calling platform that helps real estate professionals and businesses automate lead qualification, follow-up calls, and appointment booking. The service includes:

• AI voice agents that make outbound calls on your behalf
• CRM integrations for lead import and data sync
• Lead flow rules for automated lead routing
• Campaign management for call scheduling
• Call recording, transcription, and AI analysis
• Calendar integration for appointment booking
• Knowledge base for agent context
• Team management with role-based permissions
• Zoom integration for automatic virtual meeting creation

2. Account Responsibilities

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring that your use of the service complies with all applicable laws and regulations
• Obtaining necessary consents before importing contact data into the platform

3. Acceptable Use

You agree NOT to use Katherine AI to:

• Make calls that violate the Telephone Consumer Protection Act (TCPA) or any applicable telemarketing laws
• Call numbers on the National Do Not Call Registry without an existing business relationship or prior express consent
• Harass, threaten, or abuse any person
• Make calls for any illegal purpose
• Misrepresent your identity or the purpose of a call
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use the service to send spam or unsolicited communications
• Attempt to access other users' accounts or data
• Interfere with or disrupt the service infrastructure

4. Compliance

You are solely responsible for ensuring your use of Katherine AI complies with:

• The Telephone Consumer Protection Act (TCPA)
• The Telemarketing Sales Rule (TSR)
• State-specific telemarketing and call recording laws
• The National Do Not Call Registry requirements
• Any applicable industry-specific regulations (e.g., HIPAA for healthcare)
• The General Data Protection Regulation (GDPR) if applicable

Katherine AI provides tools to assist with compliance (DNC blocklist management, call recording consent features), but compliance responsibility rests with you.

5. Payment Terms

• Katherine AI is billed on a monthly subscription basis
• Payment is due at the beginning of each billing period
• You may cancel your subscription at any time — cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months
• Additional AI agents beyond the included amount are billed at $49/month each
• Call costs and phone number fees are billed separately based on usage

6. Intellectual Property

All intellectual property rights in the Katherine AI platform, including software, design, trademarks, and documentation, are owned by Leadogo LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

Content you create within the platform (scripts, knowledge base documents, contact data) remains your property. You grant us a limited license to process this content solely to provide the service.

7. Call Recordings

• All calls made through Katherine AI are recorded by default
• You are responsible for ensuring compliance with applicable call recording consent laws (one-party vs. two-party consent states)
• Katherine AI can be configured to announce call recording at the start of each call
• Call recordings are stored securely and are accessible only by authorized users on your account
• Recordings are retained for the duration of your subscription and deleted within 90 days of account termination

8. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, data, or business opportunities
• Our total liability for any claim arising from or related to the service shall not exceed the total fees paid by you in the 12 months preceding the claim
• We are not responsible for the content or accuracy of AI-generated call transcripts or summaries
• We are not responsible for appointments booked incorrectly due to calendar sync issues
• We are not responsible for Zoom meeting availability, quality, or disruptions caused by Zoom service issues

9. Indemnification

You agree to indemnify and hold harmless Leadogo LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service or your violation of these Terms.

10. Termination

• Either party may terminate these Terms with 30 days written notice
• We may suspend or terminate your account immediately if you violate these Terms
• Upon termination, your access to the platform will be revoked
• Your data will be retained for 90 days after termination, then permanently deleted
• You may request immediate data deletion at any time (see our Data Deletion page)

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the State of Florida.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
